Welcome to Build Pro, a mobile application operated by Build Pro LLC, wholly owned by the American Contractor Network ("Build Pro," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the Build Pro mobile application ("App") and related services. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent that you are 18 or older and have the legal capacity to enter into these Terms.
2. Account Registration
To access the App’s features, you must create an account by providing accurate and complete information, including your name, email address, and phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3. App Services
The App provides free tools, training, workshops, community forums, and paid features (e.g., courses, group/one-on-one coaching programs, and events) to help contractors and trade business owners grow their businesses. All services are for personal, non-commercial use only.
4. User Conduct
You agree to use the App in a lawful and respectful manner. You may not:
Engage in harassment, discrimination, or abusive behavior in community forums or other features.Misuse or reproduce App tools, training, or resources for commercial purposes.Share content that violates intellectual property rights, is defamatory, or is otherwise unlawful.Attempt to interfere with the App’s functionality or security.
Content you share in community forums or other interactive features becomes public information accessible to other users. You grant Build Pro a non-exclusive, royalty-free license to use, display, and distribute such content within the App.
5. Payment and Refunds
Paid Features: The App offers one-time purchases (e.g., workshops, in-person events) and recurring subscriptions (e.g., coaching programs, premium community access). Payment details are collected securely via third-party processors like Stripe.Refunds: You may request a refund for any purchase within 30 days of the purchase date. To cancel a subscription and qualify for a refund, you must request cancellation within 30 days of purchase. All refund requests must be submitted in writing to [email protected]. Refunds are processed at our discretion and subject to applicable laws.Non-Payment: Failure to make payments for subscriptions may result in account suspension or termination.
6. Disclaimer of Warranties
The App, including its tools, training, resources, and services, is provided "as is" without warranties of any kind, express or implied. We do not guarantee the accuracy, reliability, or completeness of any content or services. Results from using the App, including testimonials shared by users or Build Pro, are not typical, and we make no warranties regarding outcomes or business success. You use the App at your own risk.
7. Limitation of Liability
To the fullest extent permitted by law, Build Pro, its affiliates, and their respective officers, directors, and employees shall not be liable for any direct, indirect, incidental, or consequential damages arising from:
App downtime, data loss, or errors in tools, training, or resources.Your use of or inability to use the App.Any actions or outcomes resulting from your reliance on App content or services.
8. Termination
We reserve the right to suspend or terminate your account at our sole discretion for reasons including, but not limited to:
Non-payment of subscription fees.Violation of these Terms.Actions deemed a distraction, threat, or harm to Build Pro or its users.
Upon termination, your access to the App will cease, and your data will be deleted in accordance with our Privacy Policy, unless retention is required by law.
9. Intellectual Property
All content, tools, training, and resources provided through the App are owned by Build Pro or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from App content without our prior written consent.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Salt Lake County, Utah.

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms in the App or by email. Your continued use of the App after changes constitutes acceptance of the updated Terms.
